The petitioner seeks regular bail in connection with Kishanpur Police Station Case No. 137 of 2021, registered for the offences punishable under Sections 1379/411/414/34 of the Indian Penal Code.

The prosecution case, as per the First Information Report, is that the pick-up van of the informant was stolen while the same was being driven and parked by the driver of the informant in order to unload pineapples.

Learned Counsel for the petitioner submits that the petitioner has been implicated in this case on the basis of the confessional statement of co-accused persons, namely, Md. Bittu and Shushant, recorded in Madhepura Police Station Case

Patna High Court CR. MISC. No.69227 of 2021(2) dt.23-05-2022 2/3 No. 640 of 2021, in which they have disclosed that the stolen pick-up van of the informant was sold to the petitioner worth Rs. 60,000/- and the said pick-up van was recovered from outside the motor garage of the petitioner. He further submits that the petitioner runs a motor garage and he did not purchase the pick-up van; rather somebody had left the said pick-up van outside the motor garage of the petitioner for its repair. He further submits that the petitioner is in custody since 23.09.2021 and charge sheet has already been submitted against him and as such there is no likelihood that the petitioner will abscond and/or tamper with the evidence.

Regards being had to the submissions made on behalf of the parties and taking into consideration the materials on record and the fact that the stolen vehicle was recovered from outside the motor garage of the petitioner and the petitioner claims that he did not purchase the said vehicle, charge sheet has already been submitted and the petitioner is in custody since 23.09.2021, I am inclined to grant regular bail to the petitioner.

This application is, accordingly, allowed.
