The petitioner apprehends his arrest in connection with the case No.C 2 A 128 of 2016/Trial No.808 of 2016 registered under Section 47(a) of the Excise Act, 1915, pending in the court of the Chief Judicial Magistrate, Vaishali at Hajipur. The accusation is of recovery of 230 bottles, each containing 200 ml. country made liquor, kept in a plastic bag, from the shop of the petitioner on 26.01.2016. Learned counsel appearing on behalf of the petitioner submits that, in fact, nothing was recovered from the shop of the petitioner rather the petitioner has falsely been implicated in this

Having considered the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
