The petitioner seeks bail in Bakhtiyarpur P.S. Case No. 75 of 2021, registered for the offence punishable under Section 302 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, on 09.04.2021 at 8.30 pm while brother-in-law of the informant namely, Santosh Paswan was returning back by local train and reached at Champapur halt, two accused persons namely, Jitendra Paswan and Lalan Paswan shot him dead.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the basis of confessional statement of co-accused Kundan

Patna High Court CR. MISC. No.3734 of 2022(2) dt.31-03-2022 2/2 Kumar @ Golu Kumar. There is no allegation of causing firearm injury against this petitioner. As per the FIR, specific allegation of firing is against other co-accused persons. Petitioner claims clean antecedent and he is in custody since 16.05.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Barh, Patna in connection with Bakhtiyarpur P.S.
