The petitioner seeks bail in connection with Manjhagarh P.S. Case No. 56 of 2025 instituted for the offence under Sections 126(2), 115(2), 118(1), 109(1), 303(2), 352 & 3(5) of the Bharatiya Nyaya Sanhita, 2023. Earlier vide order dated 08-05-2025, passed in Cr. Misc. No. 28883 of 2025, regular bail application of the petitioner was rejected by this Court.

On 15-02-2025, the informant was attacked during his morning walk by Parshuram Singh with a sword and by petitioner with a farsa, causing serious injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 25-03-2025. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

The present one is the second attempt for grant of regular bail. Learned counsel for the petitioner mainly submits that charge in this case is framed which fact is evident from the impugned order itself. It is next contended that subsequent to the rejection of the bail of the petitioner, co-accused with similar allegation has been enlarged on bail by a Co-ordinate Bench of this Court vide order dated 15-05-2025, passed in Cr. Misc. No. 29275 of 2025.

Learned A.P.P. for the State as also learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, charge having been framed and claim based on parity, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court

(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
