2. The petitioner apprehends his arrest in connection with Madhwapur P.S. Case No. 102 of 2024, registered for the offences punishable under Sections 115(2), 126(2), 118(1), 117(2), 76, 303(2), 352, 351(2), 3(5) of the BNS.
3. While the informant was engaged in dropping of bricks on his land, in the meanwhile, all the FIR named accused persons, including the petitioner, came there and brutally assaulted him, apart from there is allegation of snatching valuables and misbehaving with the family members of the informant. There is specific allegation against the petitioner that he has inflicted knife blow over the head of the brother of the informant causing serious injuries.
4. Learned Advocate for the petitioner submitted that

No.57350 of 2025(2) dt.27-08-2025 2/3 in fact on the fateful day on account of land dispute both the parties have entered into a free fight resulting into unfortunate injury to the brother of the informant and taking benefit of the same, the present FIR has been instituted after a delay of 8 days. The alleged occurrence took place on 17.08.2024, however the present FIR has been instituted on 26.08.2024 without there being any explanation whatsoever. There is counter version of the present FIR instituted by the sister-in-law of the petitioner against the informant and others vide Madhwapur P.S. Case No. 103 of 2024. The petitioner bears one criminal antecedent as has been disclosed in para-3 of the bail application, however he is on bail in the said case. The petitioner undertakes that he will fully cooperate in the proceeding of the court.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application.

Having considered the submissions set forth by the learned Advocates for the respective parties and taking note of the delay in lodging of the FIR, coupled with the factum of case and counter case and the injury is found to be simple in nature as is evident from the impugned order, let the petitioner abovenamed be released on bail, in the event of his arrest or

No.57350 of 2025(2) dt.27-08-2025 3/3 surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st Class, Benipatti, Madhubani in connection with Madhwapur P.S. Case No. 102 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
