JUSTICE SANJAY PRIYA ORAL ORDER 4/ 18-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in Barauni (FCI) P.S. Case No.383 of 2016 instituted for the offence under Section(s) 366-B/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Begusarai.

It is alleged in the written report that daughter of the informant had gone to market for purchase but she did not return. The informant learnt that she has been kidnapped by this petitioner. It is also alleged that the informant received calls on his mobile phone from different numbers, as mentioned in the written report, giving threat that if he will make complain to police then her daughter will be killed.

Case diary has been received.

Patna High Court Cr.Misc. No.38643 of 2017 (4) dt.18-12-2017 2/2 Learned APP has stated that witnesses have supported in their statement about taking away of the daughter of the informant by this petitioner. The girl is still traceless. In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order. The Investigating Officer is directed to expedite the investigation and conclude the same at the earliest. (Sanjay Priya, J) JA/- U T
