The petitioner is apprehending arrest in Biroul P.S.Case No. 344 of 2016 instituted for the offence under Sections 147, 148, 341, 323, 324, 304, 506 and, 379 of the Indian Penal Code. It has been submitted by the learned counsel for the petitioner that allegation of assault is omnibus against this petitioner. The specific allegation of assault is against Sujit Choudhary and Priyaranjan, who allegedly caused grievous injury. It is also submitted that one of the co-accused Ajit Kumar Choudhary @ Ajit Choudhary @ Ajit Kumar Choudhary has been allowed anticipatory bail on 26.07.2017 in Cr. Misc. No. 34585 of 2017. The informant of this case has compromised the case and a
Patna High Court Cr.Misc. No.39526 of 2017 (2) dt.22-08-2017 2/2 compromise petition has been filed before the Court below. Learned Additional Public Prosecutor opposed the prayer.
Considering the facts, circumstances and nature of allegation, the prayer of Anticipatory bail of petitioner is allowed and in the event of his arrest or surrender before the Court below within a period of six weeks, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each in connection with Biraul P.S.Case No. 344 of 2016 corresponding to G.R. No. 795 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Biraul, District- Darbhanga, subject to condition as laid down under Sections 438 (2) of the Cr.P.C.
