1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. The petitioner seeks anticipatory bail, arising out of Udakishunganj Police Station Case No. 18 of 2022, disclosing offences under Sections 147, 148, 149, 353, 332, 333, 188, 171(E) of the Indian Penal Code.
3. As per the First Information Report on 24.01.2022, at about 2:30 pm, in the afternoon, the named accused persons along with 200 to 300 unknown persons blocked the Chausa More road and were protesting against the killing of ExMukhiya and the owner of the Ashirwad Clinic. The accused persons raised slogan against the police administration, attempted to damage the police vehicle and misbehaved with the
Patna High Court CR. MISC. No.61248 of 2023(2) dt.16-10-2023 2/3 police officials and created a ruckus on the road.
4. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and has falsely been implicated in the present case by the police. The allegations against the petitioner and other accused persons including the unknown persons are general and omnibus in nature and no specific overt act has been alleged against him. The three of the similarly situated co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court vide Annexure- 2 series.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner has got no criminal antecedent and the similarly situated accused persons have been granted bail by a Coordinate Bench of this Court, I am inclined to grant anticipatory bail to the petitioner.
6. This application is, accordingly, allowed.
7. Let the petitioner, Ranjan Yadav @ Ranjan Kumar Yadav @ Ranjan Kumar, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of
