The petitioner apprehends his arrest in a case registered for the offence under Section 414 of the I.P.C. and Sections 30(a), 38(1), 41(1) of Bihar Prohibition and Excise Act. 5341.470 liters of illicit foreign liquor has been recovered from five vehicles involving a truck and four Mahindra pick-up van.
It is submitted on behalf of petitioner that petitioner is neither owner nor driver of any of the vehicles in question. Nothing has been recovered from the conscious possession of the petitioner and he has been falsely implicated in this case. Petitioner has no criminal antecedent of similar nature. Considering the nature of accusation and the fact that petitioner has no antecedent of similar nature, let the above

No.69230 of 2021(3) dt.29-07-2022 2/2 named petitioner, in the event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II cum Excise Court, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 110 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
