This is a petition for grant of regular bail for offence under Sections 363, 365, 366A and 380/34 of the Penal Code. The learned counsel for the petitioner submits that the statement recorded under Section 164 of the Criminal Procedure Code in which she stated that the petitioner enticed her to Delhi on the pretext to provide service, but, after having knowledge about the filing of the case the petitioner got surrendered at Phenhara Police Station. However, it has been stated that the victim has not taken any jewellery or money and before 4-5 days of the occurrence, she has a quarrel with her husband and other persons.
Hence, having regard to the facts and circumstances of the case and the statement of the victim, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Phenhara P.S. Case No. 41 of 2015 to the satisfaction of Sri Alok Kumar Pandey, Judicial Magistrate, 1st Class, Sadar, East Champaran at Motihari. (Gopal Prasad, J) SA/- U √ T √
