2. The petitioner has preferred this application for grant of regular bail in connection with Bhabhua P.S. Case No. 414 of 2025 dated 18.05.2025 registered for the offences punishable under Sections 309(6) of the B.N.S.
3. As per the prosecution case, two unknown miscreants are alleged to have committed loot of Rs. 15,000/- and they also took away Rs. 3,500/- from the bar code of the mobile of the informant on the point of knife. One motorcycle was also recovered from the possession of the petitioner.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in
Patna High Court CR. MISC. No.61214 of 2025(3) dt.17-09-2025 2/3 this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in the confessional statement of the co-accused, Abhyas Patel. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 18.05.2025.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that at para-60 of the case diary, T.I.P. was conducted and the accused persons were identified by the informant who committed the crime.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Kaimur(Bhabua) in connection with Bhabhua P.S. Case No. 414 of 2025, with following conditions:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled. (ii) The Court below shall verify the criminal

No.61214 of 2025(3) dt.17-09-2025 3/3 antecedent of the petitioner and at any stage, if it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bonds of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the same of verification.
7. The application stands allowed.
