The petitioners apprehend their arrest in a case registered for the offence under Section 307, 379 & other allied sections of the Indian Penal Code.

As per the prosecution case, on the alleged date and time of occurrence, petitioners alongwith other F.I.R. named coaccused were cutting SHEEMAL tree and on protest by informant, they abused and assaulted him with lathi, iron axe. It is further alleged that co-accused Sumit Kumar Singh inflicted iron axe on the neck of informant, which hit on his right

It is next alleged that co-accused Amit Kumar Singh inflicted iron axe upon head of Satyam Kumar as a result of which, he received grievous injury. It is also alleged that petitioner no. 3 (Satyendra Singh) committed theft of gold locket of informant.

Admittedly, there is land dispute between the parties. Specific allegation of assault is against other co-accused persons. So far as these petitioners are concerned, there is general and omnibus allegation. There is case and counter case and both sides sustained injury.

Considering the aforesaid facts and circumstances as well as the fact that there is case & counter case and both sides sustained injury, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Punaura P.S. Case No. 142 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
