09-11-2017 Heard Sri Ramesh Kumar Choudhary, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Mahua P.S. Case No. 174 of 2017 registered for offence under Section 414 of the Indian Penal Code and Sections 30(A), 32(ii), 38(ii), & 41(i) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that save and except confessional statement of the co-accused, there is no other material to connect the petitioner in the present case, whereas, the petitioner is having clean antecedent, which fact has been stated in paragraph - 3 of the petition. Sessions Judge IInd-cum-Special Judge, Vaishali at Hajipur in connection with Mahua P.S. Case No. 174 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
