2. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 420, 376, 506 and 34 of Indian Penal Code .
3 . As per the prosecution case , informant is married lady and has two children . The husband of informant died in the year 2020 and thereafter, this petitioner came in contact with her and started talking with her. It is alleged that petitioner took her to Gerabari in a hotel and after intoxicating her, committed rape upon her. It is further alleged that he also took photographs of the alleged incident and started blackmailing her. It is further alleged that petitioner used to make physical relationship with

Learned counsel for the petitioner submits that from perusal of the F.I.R. it is apparent that when the relationship developed between the parties, both were major and informant was fully aware of the consequences of such relationship which continued for years. He further submits that acts of repeated intimacy and sexual relationship was consensual in nature and the same was not established under any false promise , threat or coercion and such , the same cannot be said to be induced or involuntary . Petitioner is in custody since 20.05.2025 .
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the aforesaid facts, and also the fact that both the parties were major, when relationship developed between them and informant was well aware of such relationship and its consequences, and as such, the same will not amount to any criminal offence and circumstances of the case and period of custody , the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-
