The petitioner apprehends arrest in a case registered for the offences punishable under sections 365/34 of the Indian Penal Code.

Brother of the victim made allegation that the petitioner and others kidnapped his brother.

It is submitted that the victim had collected crores of rupees for depositing the same in the chit fund. The owner of the chit fund died. Panchaiti was also held to refund the money and on account of this dispute the story of kidnapping was hatched up. The petitioner has no criminal antecedent. From perusal of the case diary it appears that the informant also made allegation that the petitioner and others

Patna High Court Cr.Misc. No.50638 of 2015 (3) dt.14-12-2015 kidnapped his brother Rajeev Kumar Yadav. The witnesses have also stated the same fact that for refund of money, the victim was kidnapped.

The victim also in his statement under section 164 Cr. P.C. stated that he was kidnapped. The victim was recovered from a place in a village situated in district Madhepura. Considering the facts aforesaid, I am not inclined to grant privilege of anticipatory bail to the petitioner in connection with Banmankhi P.S. Case No. 278 of 2015 pending in the court of the learned Chief Judicial Magistrate, Purnea. This application for anticipatory bail is, accordingly, rejected. (Prabhat Kumar Jha, J) Amin/- U
