The petitioner seeks pre-arrest bail in connection with Rupauli P.S.Case No.284 of 2016 registered under Sections 302, 201 and 120B/34 of the Indian Penal Code.

Considering the fact that during the course of investigation name of the petitioner transpired as one of the active participants in commission of murder of the husband of the informant, I am not inclined to grant him pre-arrest bail. Accordingly, his application filed under Section 438 of the Code of Criminal Procedure is rejected.

In case the petitioner surrenders and seeks bail, the same shall be considered on its own merits without being prejudiced in

Patna High Court Cr.Misc. No.48372 of 2017 (2) dt.18-10-2017 2/2 any manner by this order.
