2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 21 ( b ), 23 ( b ) and 24 of NDPS Act.
3 . The prosecution case in brief, is that on 10.04.2025 at about 12:05 PM, on secret information, a raid was conducted by informant and others in the shop of co-accused persons namely, Rajnikant Gupta, Ashish Kumar wherein (1) Wings Biotech LLP Onrex Cough syrup , 44 pieces of 100 ml each , ( 2 ) WORKHARDT SPASMO Proxyvon Plun Cap-300 pieces (3) 10, 72 Tablets of Nitrusum and (4) 36 pieces of Nitrazepam Tab were recovered from the shop of co-accused Rajnikan Gupta and 4 pieceas of 100 ml each of Wings biotech LLP Onrex
Patna High Court CR. MISC. No.60359 of 2025(2) dt.08-09-2025 2/3 Cough syrup was recovered from plastic bag of co-accused Ashish Kumar and the name of this petitioner was disclosed as friend of co-accused Rajnikant Gupta and Ashish Kumar.
4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged. Petitioner has been made accused in this case merely because he happens to be friend of co-accused Rajnikant Gupta and Ashish Kumar from whose shop the alleged recovery was made and this petitioner has got no concern with the alleged occurrence . No incriminating articles has been recovered from possession of petitioner. There is no other material against this petitioner to show his complicity in the aforesaid occurrence . Petitioner claims clean antecedent.
5 . Learned counsel for the State opposed the bail petition .
6 Considering the fact that no incrimination article has been recovered from the conscious possession of this petitioner, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount

No.60359 of 2025(2) dt.08-09-2025 3/3 each to the satisfaction of the learned Exclusive special Judge Court No. 1 NDPS Motihari East Champaran in connection with Bhelahi P.S. Case No. 41 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
