2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 309 (4) of the BNS.

3. The case of the prosecution in short is that the informant was returning from the house of his sister after collecting a sum of Rs. 5,00,000/- from Rahika to his house. On the way, near the Nahar bridge, two accused persons allegedly intercepted him and at gun point, Rs. 5,00,000/- was snatched. Hence the present FIR.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the

Patna High Court CR. MISC. No.58345 of 2025(2) dt.27-08-2025 2/2 FIR was lodged against unknown miscreants. During the course of investigation, his name has disclosed by the Spy and after that his confessional statement was recorded. It is also submitted that only Rs. 1600/- and one mobile has been recovered from the possession of this petitioner. There is no direct evidence against this petitioner. Moreover, the petitioner is languishing in judicial custody since 07.06.2025.

Learned APP appearing for the state has vehemently opposed the prayer of regular bail submitting that the tower location of this petitioner's mobile was also found near the place of occurrence.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kaluahi P.S. Case No. 75 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Madhubani.
