2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 382/34 of the Indian Penal Code.
3. It is a case of snatching of bag of the informant's bag containing one lac and ten thousand by the accused Vikki Kumar who was sitting behind the motorcycle with an accused. Accused Vikky Kumar named the petitioner a liner of the present loot. On his disclosure, petitioner was arrested and he confessed his guilt and at his instance looted article was recovered from his house.
4. It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.60801 of 2023(2) dt.15-09-2023 2/2 that petitioner has been falsely implicated in this case. Petitioner is not named in the FIR. General and omnibus allegation has been levelled against him. He is languishing in judicial custody since 17.5.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMII, Samastipur in connection with Samastipur Muffasil PS Case No. 274/23.
