1. Heard learned counsel for the petitioner and learned A.P.P. for the State Dr. Mrityunjay Kumar Gautam.

2. The petitioner apprehends his arrest in connection with Ara Nawada P.S. Case No.354/2025, registered for the offences punishable under Sections 8 ©, 21©, 25 and 29 of the NDPS Act.

3. Learned APP, in compliance of the order dated 15.11.2025 has filed a counter affidavit.

4. Learned counsel for the petitioner submits that petitioner has antecedent of two cases and allegation is of recovery of 1047 grams of heroin from a Swift Dzire car and 1060 grams of heroin from the house of Abhishek Kumar along with some cheque leaves, on which, the name of the petitioner was printed.

5. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that though in the FIR, it is alleged that from house of Abhishek, cheque leaves were recovered, which bore the name of the petitioner but then the account number against which the cheque leaves were issued is not of the petitioner and it appears that the said Manjit is some different person. It is submitted that on the said submission on 15.11.2025, the State was directed to file a counter affidavit.

6. Learned A.P.P. Dr. Mrityunjay Kumar Gautam submits that a counter affidavit has been filed and specific plea has been taken that cheque leaves have been recovered from the house of Abhishek does not belong to the petitioner but then it is submitted that during the course of investigation, it transpired that petitioner was in touch with Abhishek and the tower location of the mobile of the petitioner was also found near the place of occurrence. It is also submitted that FIR is not an encyclopedia, some inadvertent mistakes may have crept in but then during the course of investigation involvement of the petitioner in the occurrence has come to the fore and investigation of the case is in its nascent stages.

7. Considering the submissions made by the learned

Patna High Court CR. MISC. No.58485 of 2025(4) dt.18-12-2025 3/3 APP, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.

8. The anticipatory bail application of the petitioner is rejected.

9. The counter affidavit is taken on record.
