JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-09-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the state.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Jalley P.S. Case No. 28 of 2017 for the offences punishable under sections 147, 148, 149, 341, 323, 324, 307, 448, 153 (A), 295, 295 (A), 504, 506 and 427 of the I.P.C.
Allegedly, the petitioners and other co-accused entered into the campus of Madarsa and assaulted the students and also damaged computer, Quran Sharif and other books. Submission is of false implication and that there is no

No.44447 of 2017 (2) dt.22-09-2017 2/2 specific allegation against any one, all the allegations are omnibus and general in nature, in this case other co-accused, namely, Sundi Devi @ Sundari Devi and four others have been allowed pre-arrest bail vide Cr. Misc. No. 32866 of 2017 by another co-ordinate Bench of this Court and the case of the petitioners is similar and as such the petitioners deserve sympathetic consideration. The learned A.P.P. submits that the co-accused who have been allowed pre-arrest bail are ladies.
In the facts and circumstances stated above, considering that there is no specific allegation against the petitioners and as such they, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M, Darbhanga in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
