29-01-2020 This is 2nd attempt for grant of bail on behalf of petitioner in Sessions Trial No. 287 of 2017/381 of 2018 (arising out of Aurangabad Town P.S. Case No. 286 of 2016), registered for the offence under Sections 147, 148, 149 and 302 of the Indian Penal Code.

Earlier, vide order dated 09-11-2017 passed in Cr.Misc. No. 42522 of 2017, the prayer for bail was rejected with a direction to the trial court to conclude the trial within six months.

In this case, vide order dated 18-11-2019, a report regarding stage of the trial was called for from the court below, which has been received and kept at flag 'X', and from perusal of report dated 22-11-2019, it appears that the case is running at

Patna High Court CR. MISC. No.57175 of 2019(4) dt.29-01-2020 2/2 the stage of argument of learned defence counsel. In view of aforesaid facts and circumstances as well as the fact that trial is going on smoothly, I am not inclined to extend the privilege of bail to the petitioner. Accordingly, the petition stands dismissed.

However, while rejecting the prayer for bail, it is directed to the learned trial court to conclude the trial as early as possible, preferably; within a period of six months from today. (Prabhat Kumar Singh, J.) anay U T
