====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 20-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offence punishable under sections 341, 323, 354, 354(A), 379, 504, 506 and 34 of the Indian Penal Code. Allegedly, the sister of the informant gave Rs. 2,000 as beyana for making a gate to one Bhola Yadav. It is further alleged that the brother of Bhola Yadav, namely, Ravi Kant Yadav hurled indecent language and outraged the modesty of the Informant's sister. It is also alleged that Bhola Yadav assaulted the informant by means of rod and snatched a gold chain worth Rs. 60,000/- from the neck of the informant and he also outraged the modesty of the informant. The accused also threatened to kill both the sisters.
It is submitted by learned counsel for the petitioner that
Patna High Court CR. MISC. No.57991 of 2022(2) dt.20-12-2022 2/2 petitioner has been falsely implicated in this case. Petitioner has no criminal antecedent. Learned counsel for the petitioner submits that earlier the petitioner has filed a case against the informant and her family member and action has been taken against the informant and her family member, thereafter the present case was filed by the informant.
Learned APP for the State vehemently opposed the prayer for anticipatory bail.
Having regard to the facts and circumstances of the case and materials available on record, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Hussainganj P.S. Case No. 48 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
