The petitioners apprehend arrest in connection with Sare P.S. Case No. 87 of 2017 registered under Sections 353, 379 of the Indian Penal Code and 4/40 of the Bihar Small Mining Act and section 8(d) of the Bihar Minerals Prevention of Illegal Mining, Transportation and Storage Rule.

Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Further submission is that on perusal of the Annexure-3, it appears that petitioners have valid Challan. They have no criminal antecedent.
