The appellants seek pre arrest bail in connection with Maharajganj P.S.Case No.17 of 2017 registered for offences punishable under Sections 323, 341, 342, 307, 364 & 120(B) of the Indian Penal Code and Section 3(1)(x) of SC/ST (Prevention of Atrocities) Act.

Allegation against the appellants is of abusing the informant by taking caste name and also administering urine and there are also some serious allegations against the appellants. Submission of the learned counsel for the appellants is that as a matter of fact a case had been lodged by the appellants

Patna High Court CR. APP (SJ) No.2713 of 2017 (3) dt.18-10-2017 2/2 against the informant and his family members with respect to kidnapping of their minor daughter by the son of the informant and with a view to put pressure on the appellants, the present false and concocted case has been lodged as no such occurrence, as stated in the FIR, has took place.

Having heard both sides, this appeal is not maintainable.

Let the appellants surrender before the court of learned Special Judge and make prayer for regular bail, which will be considered by the learned Special Judge on the basis of submissions as advanced above and thereafter, he will pass appropriate order without being prejudiced by the order of this Court.

With the above observation, this appeal is disposed of.
