2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code.

3. As per prosecution case, the allegation against three unknown miscreants is that on 07.04.2023 they came to informant and hired his vehicle Scorpio to drop them Mokari and when the informant proceeded on the way near Mahathi Bridge, they stopped the vehicle and on the pistol point snatched the key of said vehicle and fled away with vehicle.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.63757 of 2023(2) dt.10-10-2023 2/2 petitioner is innocent and has committed no offence. He has falsely been implicated in this merely on suspicion. Neither the petitioner is named in FIR nor put on T.I.P. No stolen vehicle has been recovered from the conscious possession of the petitioner or his premises. It is also submitted that petitioner has got no criminal antecedent and languishing in judicial custody since 21.04.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6.Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rosera P.S. Case No. 253 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Rosera or Successor Court, Rosera, Samastipur.
