Mr.Madhuri Lata ====================================================== CORAM: HONOURABLE MR. JUSTICE P. B. BAJANTHRI ORAL ORDER 23-12-2022 The matter is heard through video conferencing. Petitioner seeks regular bail in Naugachia P.S. Case No. 136 of 2022, registered for the offences punishable under Sections394 and 364 of the Indian Penal Code. Perusal of the records it is evident that petitioner's role is only to the extent that he was giving shelter to the criminals and he is not involved in any other case. It is also submitted that co-accused Bala Mandal @ Bale Mandal has been extended bail in Cr. Misc. No. 49218 of 2022.

Accordingly petitioner has made out a prima facie case for grant of regular bail. Petitioner is directed to be released on bail on furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.57478 of 2022(2) dt.23-12-2022 2/2 each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Naugachia in connection with Naugachia P.S. Case No. 136 of 2022, subject to following conditions: (i) The petitioner shall co-operate in investigation and in conclusion of the trial.

(ii) He shall remain present on each and every date of trial till conclusion of trial.

(iii) He shall not try to tamper with the evidence or intimidate the witness to delay the conclusion of trial. (iv) In the event of default of two consecutive dates without any valid reasons, his bail bonds is liable to be cancelled.

(v) The Court below shall verify the criminal antecedent of the petitioner and in the case, at any stage, it is found that petitioner had concealed his criminal antecedent, the court below or investigating authority shall take immediate step for cancelling bail bond of the petitioner. However, acceptance of bail bonds, in terms of the aforementioned order shall not be delayed for this purpose or in the name of verification. (P. B. Bajanthri, J) rakhi/- U
