The petitioner seeks bail in connection with Sessions Trial No.461 of 2016, arising out of Turkaulia P.S. Case No.833 of 2015, registered under Section 365 and, later on, added Sections 364-A, 302 and 120-B of the Indian Penal Code, pending in the court of the 12th Additional Sessions Judge, Motihari, East Champaran.

Learned counsel appearing on behalf of the petitioner submits that while the petitioner is not named in the F.I.R. but, in course of investigation, the police got recorded the confessional statement of the petitioner, who disclosed about having his hand in

No.2444 of 2017 (2) dt.06-02-2017 2/2 the commission of the murder of the deceased Brij Kishore Dubey, the husband of the informant Kamini Devi, and also concealing the dead of the deceased in the septic tank of his house. Having regard to the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected.
