Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Gopalganj PS case no. 182 of 2024, disclosing offences punishable under Sections 3/7(2)(c) of Immoral Traffic Prevention Act.

The prosecution story, as per the First Information Report, is that on secret information that prostitution business is going on in the house of Umaratan Khatoon, the informant along with police party reached there, they found three ladies and three gents in objectionable condition, out of which one male fled away. In presence of independent witnesses, apprehended persons disclosed their names as Umaratan Khatoon, Munni Devi, Puja Devi, M.D. Nawaz, Ashgar Ali and Bhuttu Kuraishi. No.66952 of 2024(2) dt.11-11-2024 2/2 persons disclosed that they are sex workers and petitioner and his mother Umaratan Khatoon run the prostitution business by calling the boys and girls in their house. It has further been alleged that the petitioner managed to escape from the place of occurrence at the time of police raid.

Learned Counsel for the petitioner submits that petitioner has falsely been implicated in this case due to the fact that petitioner is son of co-accused Umaratan Khatoon, however he is living separately from her mother. Learned counsel further submits that petitioner has nothing to do with the alleged occurrence.

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that the name of the petitioner has been disclosed by the arrested persons and the petitioner is having criminal antecedent of similar nature of offence, I am not inclined to grant the privilege of anticipatory bail to the petitioner.

This application is, accordingly, rejected.
