2. The petitioner has preferred this application for grant of regular bail in connection with Nadi P.S. Case No. 02 of 2021 dated 08.01.2021 registered for the offences punishable under Sections 307, 353 read with 34 of the Indian Penal Code and Sections 25(1-B)a, 26, 27 and 35 of the Arms Act.
3. As per the prosecution case, on 08.01.2021 at about 9:00 P.M., the informant got a secret information that Shabnam Yadav along with his accomplices is planning to loot crops. For verification of the same, the informant reached near the house of Shabnam Yadav and apprehended three persons. On being searched, one country made pistol and 30 pieces of live
Patna High Court CR. MISC. No.58784 of 2025(2) dt.14-11-2025 2/3 cartridges were recovered from the co-accused Shabnam Yadav. Further, one semi-automatic rifle, three country-made rifles and one country-made carbine were also recovered by the police.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the said recovery and his name has transpired only on the basis of the confessional statement of the co-accused Shabnam Yadav. Similarly situated co-accused person has already been granted bail by this court vide order dated 25.08.2023 passed in Cr. Misc. No. 53390 of 2023. The petitioner has five criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 18.10.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Naugachai in connection with Nadi P.S. Case No. 02
Patna High Court CR. MISC. No.58784 of 2025(2) dt.14-11-2025 3/3 of 2021, with the conditions :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
