Petitioner apprehends his arrest in connection with Maker P.S. Case No. 29 of 2007 registered under Sections- 302 and other allied sections of the Indian Penal Code, section 27 of the Arms Act, sections 3/4/5 of the Explosive Substance Act and 17 CLA Act.

It is alleged that when informant came back to his house, 50-60 moist including 5-6 women with arms attacked his house. Accused persons opened fire. In that wife, uncle and bodyguard got injured. Mritunjay Kumar died. They set a motorcycle on fire and taken away Rs. 1,50,000/-, ornaments clothes etc.

Patna High Court Cr.Misc. No.220 of 2017 (3) dt.13-02-2017 2/2 Learned counsel for the petitioners submits that petitioners are not associated with any moist organization and he has been implicated in this case only on suspicion. Similarly situated co-accused persons have been granted bail by this Court vide order dated 20.04.2011 passed in Cr. Misc. No. 45097 of 2010.

Considering the facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Maker P.S. Case No. 29 of 2007 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
