2. The present writ petition has been filed for directing the District Programme Officer (Respondent No. 4) to dispose off the complaint dated 27.08.2018 contained in

Patna High Court CWJC No.20624 of 2018(2) dt.07-10-2024 2/3 Annexure-3 filled by the petitioner. Further prayer has been made for directing the respondent authority to cancel the selection of the Respondent No. 8 on the post of Anganbari Sevika, Panchayt- Farpar, Ward No. 3, District Sheikhpura and select the petitioner on the said post.

3. Learned Counsel for the petitioner submits that though he is well aware that he has to move before the Original Authority regarding his grievances, but he submits that he has filed his complaint before the District Programme Officer, Sheikhpura (Respondent No. 4) on 27.08.2018 as contained in Annexure-3 on which, no decision has been taken as yet. Therefore, he has no option left but to move before this Hon'ble Court.

3. Learned Counsel for the State submits that if petitioner has filed his complaint before the District Programme Officer, Sheikhpur, then District Programme Officer, Sheikhpur is bound to pass order on the complaint filed by the petitioner.

5. Accordingly, the present writ petition is disposed off directing the Respondent No. 4 (District Programme Officer, Sheikhpur) to pass a reasoned and speaking order on the complaint filed by the petitioner within 30 days, after Durga Puja Holidays, if no order has been passed till date.

6. It is made clear that petitioner is hereby granted liberty to supplement the said complaint, if he wants to do so. (Dr. Anshuman, J) Sunnykr/- U
