Patna High Court MJC No.3318 of 2019(3) dt.02-11-2022 2/2 02-11-2022 The present petition has been filed for restoration of CWJC No. 164 of 2019, which stood dismissed for default by order dated 11.07.2019.

Learned counsel for the petitioner was suffering with high fever and had requested his colleague to attend to the writ proceedings arising out of CWJC No. 164 of 2019. When the writ petition was taken up, there was none to represent the petitioner. It was under such circumstances that writ petition has stood dismissed for default, as per petitioner's counsel. The reasons are accepted as sufficient cause for restoration of the instant petition. Accordingly, CWJC No. 164 of 2019 is restored to its original file.

The restoration petition is allowed.
