1. Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the informant.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Section 498(A), 323, 504 of the IPC in connection with Complaint Case No.427C of 2021.

3. The learned counsel for the parties jointly submitted that the case was taken up on 16.12.2024 and the petitioner and the O.P. No.2 were directed to remain physically present before this Court and the case was fixed for 20.12.2024, but then the case could not be taken up.

4. It is further submitted thereafter the case was taken

No.62467 of 2024(5) dt.22-01-2025 2/2 up on 07.01.2025 when it was prayed that the case be kept for 15.01.2025, but then the case was not listed on 15.01.2025 and has been listed today, as such the petitioner and the O.P. No.2 in compliance of the order dated 16.12.2024 are present in the Court.

5. The O.P. No.2 who is present in the Court at the outset submits that she is staying happily with the petitioner and asserts and submits that anticipatory bail be granted to the petitioner.

6. In view of the submissions made by the O.P. No.2 the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bailbonds in the sum of Rs.2000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Vth, Supaul in connection with Complaint Case No.427C of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
