Petitioners apprehend arrest in a case registered for the offence punishable under sections 379, 506/34 and other ancillary sections of the Indian Penal Code.

Prosecution case is that petitioners are alleged to have assaulted the informant by sickle and it is further alleged that petitioner no.1 set the house of the informant on fire. Learned counsel for the petitioners submits that the informant has sustained injuries found to be simple in nature. Learned counsel appearing for the State opposes the prayer for bail.

Patna High Court CR. MISC. No.69749 of 2021(3) dt.13-07-2022 2/2 Considering the nature of allegation, prayer for bail of the petitioner no.2 is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner no.2 mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Bhagalpur in Shakkund Sajour Police Station Case No. 129 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.

Considering the specific allegation against the petitioner no.1 that he set the house of the informant on fire, his prayer for bail is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
