Dr. Ajeet Kumar, APP ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 20-12-2017 Heard learned counsel for the petitioner and the State. Petitioner Chandrashekhar Azad was granted bail along with three others vide order dated 29.9.2016 passed in Cr. Misc. No. 34408 of 2016. It is submitted that the petitioner was not allowed to furnish bail bond on the ground that it was apparent from order dated 28.2.2014 that the cognizance was taken only against Raje Yadav, Lal Babu Yadav, Rajeshwar Yadav, Ramiqwal Yadav, Raje Yadav, Jibachh Yadav, Vinay Yadav and Jai Kishore Yadav. Petitioner's name did not find place in the cognizance order. Petitioner claims that it was told to him that he is not required to furnish bail bond as he has not been sent up for trial. However, such cognizance order subsequently was corrected on 18.9.2017 and petitioner's name was included in

Patna High Court Cr.Misc. No.56991 of 2017(2) dt.20-12-2017 2/2 the order.

Thus, it is contended that now since time granted for furnishing bail bond has elapsed, petitioner's bail bond is not been accepted.

Accordingly, the petitioner seeks extension of time for surrender and furnishing bail bond.

In the facts and circumstances of the case, let the period of surrender as per order dated 29.9.2016 passed in Cr. Misc. No. 34408 of 2016 be extended by further four weeks from the date of this order.

This application stands disposed of.
