2. In this case, the petitioner is seeking regular bail in connection with Sessions Case No. 349 of 2024 arising out of Narpatganj P.S. Case No. 639 of 2023, registered for the offences punishable under Sections 363, 366(A)/34 of the IPC.
3. As per allegation, the petitioner abducted the minor grand-daughter of the informant and forcibly married with her.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has submitted further that the victim, under Section 161 of the Cr.P.C., did not support the prosecution case. The petitioner is under custody since 06.11.2023.
5. The xerox copy of the statement of the victim under Section 161 of the Cr.P.C. is Annexure-2. From perusal thereof, it appears that the victim has stated during course of investigation
Patna High Court CR. MISC. No.63542 of 2024(2) dt.11-09-2024 2/2 that her parents were out of station and she was residing with her grand parents. On the day of occurrence, her grand-mother had scolded her due to which she went from her house to the house of her cousin grand-mother. When the cousin grand-mother informed her grand-parents about the presence of the victim in her house, then she went to the house of the petitioner.
6. From perusal of the statement of the victim under Section 161 of the Cr.P.C., the complicity of the petitioner doesn't appear in the present case.
7. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J.-IV, Araria in connection with Sessions Case No. 349 of 2024 arising out of Narpatganj P.S. Case No. 639 of 2023, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
