The petitioner seeks bail in G.R.P. Patna P.S. Case No. 45/2016, registered for the offences punishable under Section 379 of the Indian Penal Code.

The informant lodged the case against unknown for theft of her hand bag containing different ornaments and other articles. Learned counsel for the petitioner submits that petitioner was arrested in connection with G.R.P. Patna P.S. Case No. 43/2016 and many stolen articles of the present case were recovered. Those were put on Test Identification Parade and duly identified by the informant of the present case. It is submitted that the petitioner is in jail since 11.05.2016 and similarly situated coaccused Sabir Alam has already been enlarged on bail by the court

Patna High Court Cr.Misc. No.55400 of 2016 (3) dt.01-03-2017 of learned Additional Sessions Judge X, Patna. The petitioner has already been enlarged on bail in G.R.P. Patna P.S. Case No. 43/2016 registered under Section 414 of the Indian Penal Code. Considering the facts aforesaid and the fact that petitioner has already remained in jail for more than nine months, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate Ist Class, Patna in connection with G.R.P. Patna P.S. Case No. 45/2016.
