The petitioner seeks bail in a case registered for the offences punishable under Sections 341,504, 323, 324, 325, 307, 379, 302 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 18.07.2021, is a person with clean antecedent, charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the informant alleges that the named accused persons along with 30-35 unknown accused came variously armed at the house of the informant and assaulted the informant fracturing his right hand and right arm, further when the informant's son, along with Pradeep Jha and Bhogendra Jha came to save him, they

Patna High Court CR. MISC. No.69427 of 2021(2) dt.26-04-2022 2/2 were also assaulted and Bhogendra Jha died during the course of treatment and the occurrence was on account of dispute relating to flowing of water.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and there is a delay of six days in lodging the F.I.R. and co-accused namely, Jeevan Ram and Maghi Ram have been granted bail by order dated 27.05.2021 passed in Cr. Misc. No.23506 of 2021. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 18.07.2021, is a person with clean antecedent, chargesheet has been submitted in the case and the co-accused have been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Raj Nagar P.S. Case No. 197 of 2020.
