The petitioner is aggrieved by the order dated 3.1.2015 of the District Programme Officer, Saharsa whereby the appointment of the petitioner as Anganwari Sevika in Mohalla Mankhaha, Anganwari Kendra No. 206, Ward No.1, in the district of Saharsa has been terminated.

It is not in dispute that the petitioner has preferred a

Patna High Court CWJC No.54 of 2017 (2) dt.25-01-2017 statutory appeal before the Deputy Director (Welfare), who was the competent authority at the relevant time but in view of amendment in the guidelines, it is stated that the appeal has since been transferred by the Deputy Director (Welfare) to the District Magistrate cum Collector, Saharsa and is pending before him since 4.9.2015.

In the circumstances so taken note of hereinabove, for the present, I deem it fit and proper to dispose of this writ petition with a direction to the District Magistrate cum Collector, Saharsa to consider and dispose of the appeal preferred by the petitioner in accordance with law and after opportunity of hearing to the petitioner expeditiously and preferably within three months from the date of receipt/ production of a copy of this order.
