2. The petitioner seeks bail in a case registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per F.I.R., on 09.02.2024, it is alleged by informant that on 08.02.2024 at about 9:30 P.M. while his brother was returning home from the market, all the accused persons including these petitioners caught his brother and fired upon him, due to which he sustained firearm injury and when he was taken to Paras Hospital for treatment, the doctor declared him dead.

4. Learned counsel for the petitioner submits that Coaccused persons having similar allegation have already been granted bail by this Court vide order dated 06.12.2024 in Cr. Misc. No. 61244 of 2024, order dated 24.01.2025 in Cr. Misc. No. 84248 of 2024 and order dated 18.04.2025 in Cr. Misc. No. 20979 of 2025. Petitioner No. 1 is in custody since 09.07.2025 and Petitioner No. 2 is in custody since 17.05.2025.
5. Learned A.P.P. for the State vehemently opposes the prayer for bail.
6. Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Danapur in connection with Khagaul P.S. Case No. 33/2024, G.R. No. 800/2024. (Prabhat Kumar Singh, J) P.K.P./- U
