JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Maner P.S. Case no. 358 of 2016, registered under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code. The accusation is that five persons named in the F.I.R., including the petitioner, armed with stick, Garasi and iron rod surrounded the informant Binay Kumar. At that time, this petitioner caused injury at the head of the informant through stick and Pramila Devi snatched cash of Rs. 1000/- from his pocket. Learned counsel for the petitioner submits that due to grudge and enmity occurrence took place in which Urmila Devi, wife of the petitioner, was dragged from her hut and also assaulted by the informant and others regarding which Maner P.S. Case No. 359 of 2016, under Sections 341, 323, and 504/34 is

Patna High Court Cr.Misc. No.55365 of 2016 (2) dt.23-12-2016 2/2 instituted on the basis of the fardbeyan of co-accused Parmila Devi against informant and others of the present case. The petitioner having no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Randhir Kumar, J.M. 1st Class, Danapur, Patna in connection with Maner P.S. Case No.358 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
