The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 376, 120B of the Indian Penal Code and 4 of The Protection of Children from Sexual Offences Act, 2012.

It is alleged that the petitioner being the cousin of the informant used to establish forceful physical relationship since last 6-7 months on the promise to marry. Subsequently the petitioner refused to marry and assaulted her. It appears from the medical report that the age of the informant was found 16-17 years. The Medical report suggests that the informant was sexually assaulted just prior to the medical examination.

No.54452 of 2015 (2) dt.01-12-2015 2/2 Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Abadpur (Mahila) P.S. Case No. 19 of 2015 pending in the court of learned Additional Sessions Judge-I - cum- Special Judge, Katihar.
