JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bihta P.S. Case No. 604 of 2016 registered under Section-47(a) of the Bihar Excise Act.
Six bottles of Indian made foreign liquor are said to have been recovered from the water tank of house of the petitioner.
Submission on behalf of petitioner is that the alleged recovery has been made from the joint house and moreover, some tenants were also residing in the aforesaid house and, therefore, in the aforesaid circumstance, the petitioner deserves privilege of anticipatory bail.

Case No. 604 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
