JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-01-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Jehanabad Mahila P.S. Case No. 43 of 2016 registered for the offence punishable under Sections 323, 498(A), 379, 504, 506 and 34 of the Indian Penal Code. The allegation of the informant is regarding her being assaulted by her husband and she being harassed by the accused persons on account of non fulfillment of the demand for dowry. The learned counsel for the petitioners submits that the petitioners herein are mother-in-law, father-in-law, sister-in-law and the husband of the sister-in-law of the informant. It is further

Patna High Court Cr.Misc. No.4365 of 2018 (2) dt.25-01-2018 2/2 submitted that there is a specific allegation against the husband of the informant and the petitioners herein are in no way having any complicity in the present case. It is further submitted that during the course of investigation, the statement of the brother of the informant has been recorded and he has stated that the informant has already married without waiting for final verdict of the divorce case pending between the husband and the wife. It is further submitted that the petitioners are having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad in connection with Jehanabad Mahila P.S. Case No. 43 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
