JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-01-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Chakia P.S. Case No. 154 of 2016 registered under Sections 457 and 380 of the Indian Penal Code.

The accusation is that, on 24.08.2016, the wife and other family members of informant had gone for medical treatment. On 25.06.2016, they came in the morning and found that the door of the house is opened when they entered in the room then found that the household articles and other utensils were stolen. Patna High Court Cr.Misc. No.55765 of 2016 (2) dt.16-01-2017 came to know that petitioners and one Avinash Thakur under conspiracy committed theft in the house of the informant. Learned counsel for the petitioner submits that, in fact, petitioners and the informant are co-villagers and they have falsely been implicated in this case mere on suspicion. Further submission is that petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VIII, East Champaran at Motihari, in connection with Chakia P.S. Case No. 154 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
