The petitioner apprehends his arrest in connection with Bakhtiarpur P.S. Case No. 131 of 2016 registered under Sections 147, 148, 149, 341, 323, 342, 324 and 307 of the Indian Penal Code and 27 of the Arms Act, pending in the court of the Chief Judicial Magistrate, Saharsa.
The accusation is that 14 persons including the petitioner, named in the First Information Report, surrounded the informant and this petitioner-opened fire, causing injury at the thigh of the informant.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not
Patna High Court Cr.Misc. No.2522 of 2017 (2) dt.07-03-2017 2/2 inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trail Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
