The petitioner is languishing in jail since 29.10.2016 in a case registered for offences punishable under Section 414 of the Indian Penal Code.

The prosecution case as lodged by the police personnel is that during course of search, the petitioner was apprehended with a motorcycle and he could not produce any papers regarding the ownership of the said vehicle.

It has been submitted by the learned counsel for the petitioner that he is innocent and has no criminal history. In fact he has bought vehicle from one Niraj kumar for Rs. 18000/- as an advance and he paid only part money of Rs. 8000/-, hence, the

Patna High Court Cr.Misc. No.498 of 2017 (2) dt.16-01-2017 2/2 vehicle could not be transferred and registered in his name. In the meantime, he has been apprehended by the police party. He further submits that charge sheet has already been submitted, hence there is no chance of tampering with the prosecution evidence.

However, learned A.P.P. for the State submits that the petitioner is named in the F.I.R. hence, opposes the prayer for bail. Considering the facts and circumstance of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each the to the satisfaction learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.
