JUSTICE SANJAY PRIYA ORAL ORDER 15-11-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Marhawrah P.S. Case No. 304 of 2017 instituted for the offence under Sections 302/32 of the Indian Penal Code and Section 27 of the Arms Act.

There is specific allegation against this petitioner that he fired shot on the son of the informant, on account of which, he died.

The learned Sessions Judge has mentioned in the impugned order that firearm injury was caused to the deceased by this petitioner.

A supplementary affidavit has been filed on behalf of the petitioner wherein it is mentioned that petitioner has criminal

Patna High Court Cr.Misc. No.51710 of 2017 (3) dt.15-11-2017 2/2 antecedent and a case being Marhowra P.S. Case No. 44 of 1998 is pending against him.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.
