====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 17-05-2023 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Chautarwa P.S. Case No. 251 of 2022, registered under Section 341, 323, 324, 504, 506,307, 354 and 379/34 of the Indian Penal Code.

As per allegation made in the F.I.R. the petitioner and other co-accused have assaulted the informant. Learned counsel appearing on behalf of the petitioner submitted that no such incidence took place and petitioner has falsely been implicated in this case. The injuries sustained by the informant is simple in nature. The occurrence took place due to land dispute. There is case and counter case. Learned A.P.P. for the State has vehemently opposed

Patna High Court CR. MISC. No.64591 of 2022(3) dt.17-05-2023 2/2 the prayer for grant of pre-arrest bail to the petitioner. Having heard both the sides and the material available on the record as well as considering the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Chautarwa P.S. Case No. 251 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. The court below is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in some other cases as what has been stated in paragraph No.3 of the bail application, this order will automatically loose its force.
